The Service is available only to individuals aged 18 or older. ExecMind.ai offers flexible subscription plans for users, including monthly and yearly subscriptions. Prices may vary depending on the plan chosen. All subscriptions auto-renew unless canceled before the start of the new term. By subscribing, users agree to pay the subscription fees as outlined on the pricing page.
Users will be sent a notification prior to the auto-renewal of their yearly subscription, giving them time to cancel if they do not wish to continue the service.
Payments are processed through Stripe, and users authorize ExecMind to charge their payment method on a recurring basis based on the selected subscription plan. Users agree to provide accurate and updated payment information and understand that failure to maintain valid payment details may result in suspension of their account.
ExecMind reserves the right to modify subscription fees with a minimum of 30 days' notice.
Non-Refundable Fees: Subscription fees are generally non-refundable except where required by law.
7-Day Risk-Free Trial for New Subscriptions: New subscribers can cancel within the first 7 days and receive a full refund.
Reminder: You will be sent a reminder email before your yearly subscription automatically renews. You may cancel your subscription at any time before the renewal date by accessing your account settings. If you cancel your subscription after the 7-day period, you will not be entitled to a refund for the remainder of the subscription term.
Users agree to use the Service only for lawful purposes. Unauthorized use, including reverse-engineering, prompt-injections or other attempts to manipulate the service beyond its intended use, reselling, or modifying the Service, is prohibited.
ExecMind.ai is not responsible for any business decisions made based on the Service’s output. Users are encouraged to use the Service as a tool for thought partnership and should conduct additional research and consult other resources for business decisions.
Users acknowledge and agree that they are solely responsible for any business decisions they make. ExecMind.ai uses Large Language Models (LLMs) to provide insights, but they may occasionally produce errors or incomplete information. Users remain fully responsible for the content they upload, share, or make available through the Service, including any confidential or sensitive information.
By submitting content, users grant ExecMind a limited, non-exclusive, worldwide, royalty-free license to use, distribute, and display the content solely for the purpose of providing and improving the Service to the User. This license is strictly for operational purposes and does not allow ExecMind to disclose, modify, or use the content for marketing purposes, LLM model training, or other uses without explicit consent from the user.
ExecMind is committed to safeguarding all user-provided content, including confidential and sensitive information, in accordance with our Privacy Policy. We will not share or distribute such content except as required to deliver the Service.
Users must not submit content that violates intellectual property rights, privacy rights, or applicable laws. ExecMind reserves the right to remove or modify any content that violates these Terms or applicable law.
User Termination: Users may terminate their account at any time by contacting support@execmind.ai.
ExecMind.ai Termination: ExecMind.ai reserves the right to suspend or terminate accounts at its discretion, particularly in the case of any violation of these Terms or misuse of the Service.
Upon termination, users will lose access to the Service immediately, and no refunds will be issued for unused portions of the subscription period except as outlined in the Refund Policy.
ExecMind collects and uses personal data in accordance with its Privacy Policy.
ExecMind may share certain data with third-party service providers, such as payment processors, for the purpose of delivering the Service.
While ExecMind takes reasonable measures to protect user data, it cannot guarantee absolute security. ExecMind, Inc. will not be liable for any unauthorized access to or loss of data except in cases of gross negligence or willful misconduct.
No Guarantee of Availability: The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. ExecMind does not warrant that the Service will be uninterrupted, error-free, secure, or compatible with your systems or third-party services.
Service Modifications: ExecMind reserves the right to modify or discontinue aspects of the Service with reasonable notice.
No Warranty: To the fullest extent permitted by law, ExecMind will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business or goodwill, or other intangible losses, even if ExecMind has been advised of the possibility of such damages. In no event will ExecMind's total liability for all claims exceed the amount you paid ExecMind in the twelve (12) months preceding the claim.
Force Majeure: ExecMind will not be liable for any failure to perform its obligations hereunder due to unforeseen circumstances or causes beyond its reasonable control, including but not limited to acts of God, natural disasters, terrorism, war, internet outages, government action, or labor disputes. This includes, but is not limited to, failures or interruptions in third-party services (e.g., payment processors, cloud hosting providers).
Arbitration Agreement: Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration, not in court.
Governing Law: These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
